July 22 2004 - 2 months after our water infiltration issues start,
Heartland Homes states - "Wet Basement remedy to begin in the next few weeks.
We are working with Supervisor."
September 21 2004 - 4 months after our water infiltration issues start. Our custom home builder Heartland Homes states - "Due to the EXTREME AMOUNT of WATER Friday, etc."
January 21 2005 - 8 months after our water infiltration issues start.
11 months after we closed on our brand new Heartland Homes home, Heartland Homes states -
"...We will CONTINUE to Work Towards a Solution. The weather is a factor now. etc"

May 21 2004 is when water first infiltrated our brand new Heartland Homes custom built home.
From May 21, 2004 - January 21 2005
(8 month timeframe) we sent 17 emails to Heartland Homes Warranty Department.

January 21 2005 - 8 months after our water infiltration issues start. 11 months after we closed on our brand new Heartland Homes home, Heartland Homes states -

May 2005 We hear nothing further from Heartland Homes our custom home builder. No one came into our home at any time during our 1 year warranty to specifically view our water issues. No one from Heartland Homes called us to ask us IF our water infiltration issues were resolved. Basically we followed Heartland Homes protocol to report our issues. Heartland Homes responded three different times with the emails you see above, they were working on our issues, that was it.
We did call and speak to someone specifically within the Heartland Homes warranty Department. What we were told, we decided not to post on our website. At our trial it was considered here say, so we are leaving that comment out of our details.
May/June 2005 - We send a letter to the owner(s) of Heartland Homes - certified letter signed for, almost 3 weeks later - no response. Click image directly below to view part of the letter, some photos and additional details including signature our certified letter was received.

June 2005 - After we file our Heartland Homes Pittsburgh complaint with the Better Business Bureau; the VP of Heartland Homes, now President of Heartland Homes Marty Gillespie calls me to discuss our issues on June 16 2005.
In June 2005 Marty Gillespie also visits our home to introduce himself and also review the issues we are having with our Heartland Homes built home.

Marty Gillespie is now the President of Heartland Homes Pittsburgh at least during our court trial in December 2008.
That is how he introduced himself on the stand in December 2008.
Marty Gillespie of Heartland Homes in Pittsburgh visited our home June 2005. Emails I sent to Marty Gillespie below are after his visit. Emails are from July 2005, August 2005 and two emails I sent to him September 2005.
I don't recall when I received Marty Gillespie's email address. It could have been given it to me during our initial phone conversation, when Marty Gillespie called me after we filed our complaint with the Better Business Bureau or during his visit to our home that his company, Heartland Homes in Pittsburgh built. I don't recall exactly what I received it, but his email address was given to me.

June 21 2005 - Marty Gillespie of Heartland Homes confirms a date and time to come to our home to see our water issues. Marty also brings along Craig, Craig is introduced to be as our point person or foreman (if you will). Marty discussed what needed to be corrected with our home and Craig was to ensure this work was handled. I, Dave Romesburg was present and I am paraphrasing, basically that was the reason for the visit from Marty Gillespie and Craig, from my understanding.
June 29 2005 - Heartland Homes response to the Better Business Bureau;

We knew Heartland Homes Warranty did not cover "DAMP SPOTS" as referenced in their warranty.
We were never told we had "Damp Spots", every reference from Heartland Homes stated our issues
were "WET" issues since July 22 2004, again see emails from Heartland Homes, initial response to the BBB from Heartland Homes, etc.
June 2005 - Please keep in mind that Marty Gillespie President of Heartland Homes (VP of Heartland Homes at that time)
entered our home AFTER we filed our Better Business Bureau case to see our issues.
Never once when Marty Gillespie, Vice President of Heartland Homes Pittsburgh at the time, was at our home, (after we filed our Better Business Bureau case),did he tell me our issues were "damp spots".
Marty Gillespie looked at our issues, introduced me to Craig and discussed with Craig what needed to be done.
Craig was introduced to me, Dave Romesburg, as the foreman to take care of our issues and be our go to person, period!

August 26 2009 - Additional costs we've incurred buying our new home.
Cost breakout further below does NOT include the actual costs to repair our home to STOP over 5 years of water infiltration.
Please ALSO NOTE since our trial December 2008 and the discontinuance we filed with our case April 27 2009
(see Court Trial Details) (due to the fact we had to already spent over $25,000.00 to get to that point, WITHOUT repairs to our home).
Our court verdict was less than $12,000.00 and that was appealed by Heartland Homes; We also discovered window and door flashing not installed in areas where we removed brick (by chisel) & pulled back our vinyl siding.
According to the 2000 International Building Code, 2003 International Building Code,
the window Manufacturer of our windows Andersen Windows and the Certified Structural Engineer we paid to inspect our home;
flashing IS to be installed.
Below are photos showing where we chiseled the brick from the front of our home. Additionally we pulled our siding back to verify whether flashing was installed, per Andersen Windows, 2000 or 2003 building codes.
How we go from a "WET BASEMENT" to "DAMP SPOTS" which Heartland Homes Warranty does not cover.
According to Heartland Homes documentation; their warranty does NOT cover "DAMP SPOTS" on foundation walls.
For almost 2 years we were never told we have "DAMP SPOTS" on our foundation walls.
To us and in our opinion, we have WET areas showing water percolating, bubbling, running down
our foundation. In our opinion those areas are NOT "DAMP SPOTS"
STAGE 4 - October 4 2006 - After we found water in our electrical panel due to a "COMPROMISED CONDUIT" the electrician found; Heartland Homes response is the "Company Seeks To Make Repairs."
IMPORTANT NOTE: Please read all of the references above to our "WET BASEMENT", including the
last one dated October 4 2006 to the Better Business Bureau, FROM Heartland Homes Pittsburgh, the builder of our brand new home.
OCTOBER 17 2006 - 13 days later read below the new references to our issues now being
considered simply "DAMP SPOTS". Picture below is the basement in our custom
love Heartland Homes home.
According to the documentation from Heartland Homes
July 22 2004 - October 4 2006 (over 31+ months after closing); we have a "WET BASEMENT", "EXTREME AMOUNT OF WATER", signed documentation to the Better Business Bureau from Heartland Homes Pittsburgh "WET BASEMENT problems..." and "Company Seeks to make repairs"
for OVER TWO (2) years our water infiltration is referenced as "WET" from our builder Heartland Homes in Pittsburgh.
THEN OCTOBER 17 2006 our water infiltration is NOW REFERENCED as "DAMP SPOTS" to the same Better Business Bureau that Heartland Homes earlier referenced our water issues as "WET BASEMENT".
THEN NOVEMBER 3 2006(few weeks after the BBB response directly above) our water infiltration is NOW REFERENCED to
the Pennsylvania State Attorney Generals office as "Heartland Homes will continue to monitor the situation but believes that the remedial steps taken have ELIMINATED THE WATER STAINING ISSUE."
Directly below October 17 2006 (13 days later) Heartland Homes now refers to our
WET BASEMENT as simply "DAMP SPOTS", and their warranty does NOT cover "DAMP SPOTS".
From July 22 2004 - October 4 2006 - According to Heartland Homes, we've had a WET BASEMENT.
For whatever reason starting October 17 2006 - we now have a "DAMP SPOTS."

STAGE 5 - October 17 2006 - After we request escalating our issues because here we are 2+ years after we closed on our brand new
Heartland Homes custom built home and we are still having water infiltration issues, now water also in our electrical panel due
to an "COMPROMISED CONDUIT" that brings the electricity into our home.
Heartland Homes response is the "Company states they performed work on customer's townhouse and this work was done as a COURTESY." "It is stated in customer's warranty that "Damp Spots on foundation walls do not constitute a wet basement." Company further states they are not responsible for damp spots on foundation wall."
STAGE 6 - November 3 2006 - Heartland Homes response to the State Attorney Generals Office;
"Heartland Homes will continue to monitor the situation but believes that the remedial steps taken
have ELIMINATED THE WATER STAINING ISSUE."

Here is what we spent in legal fees to try to get our water issues resolved. Please keep in mind, during our
1st year, we were told specifically by Heartland Homes "WET BASEMENT remedy to begin...", "DUE TO THE
EXTREME AMOUNT OF WATER..." & "WE WILL CONTINUE TO WORK TOWARDS a SOLUTION..."SEE ABOVE...
2007 Legal Fees we paid = $5,188.25
2008 Legal Fees we paid = $10,998.78
2009 Legal Fees we paid = $3,229.35 all totaled we paid $19,416.38 just in legal fees and our water issues were never resolved.
Total out of our pocket to date paid including deposition fees, BBB arbitration materials, etc = $26,026.83

5 year history with water infiltration issues into our brand new Heartland Homes home.
Water issues started 3 months after closing on our brand new Heartland Homes house.
Heartland Homes was notified every single time we had water infiltration. As you can see above,
we were told they were working on our issues.
Shortly after our 1 year warranty was over, we never heard back from our new home builder, Heartland Homes.
Even thought we were told Heartland Homes was working on our water infiltration issues, we never saw any
changes in the amount of water coming into our brand new Heartland Homes home.
We were never told about anything they were working on to correct our water issues.
We were never asked if there were changes to the water infiltrating our home.
Nor were we even told they were done working on the outside of our home to correct our
water infiltration issues, nothing?
Even after we sent a certified package that was signed for to the office of the owner(s)of
Heartland Homes Pittsburgh Alan Gillespie or Marty Gillespie, we hear nothing.

After we filed a case with the Better Business Bureau, shortly thereafter we hear back from the builder.
Marty Gillespie then called me to discuss our issues and came to our home to see our new home issues.
I was told they would resolve our issues and I was introduced to Craig Faulkner to be the person we work with.
During our BBB case filing, we saw Heartland Homes attempting to repair our water infiltration issues.
The work Heartland Homes did was at grade level and below, nothing above grade for whatever reason.
They did seal the lower brick on our home, that was it. None of our water issues resolved by the builder that
built our Heartland Homes home.
They never resolved our water infiltration issues during our BBB case, our next step was the court system.
All details are outlined in our website, which I am still working to complete.
We won the verdict from the Judge in our lawsuit, along with some monies for some of the repairs to our home.
Since we did not submit a granular detailed inspection, like we initially should have, the monies portion of our verdict was minimal.
Heartland Homes appealed the monies portion of our verdict.
Since the monies portion was around $11,000.00 and we already spent over $25,000.00 in legal fees, deposition costs,
replacing our electrical panel & still needed to spend another $20,000+ minimally for repairs
= why should we bother spending any more of our monies on an appeal?
We will be upside down over $50,000.00+ including the repairs to our brand new Heartland Homes home.
Our new home builder Heartland Homes did state they would continue to work towards a solution during our 1 year warranty.
That solution never happened, see all of the details below, including the emails stating they were working on our issues!
We filed a discontinuance (April 2009) and we didn't have to signed away any of our rights to post our experience online.
IF you were told we have been in and out of court for this, that is true however only from the standpoint
Heartland Homes appealed the monies portion of our verdict.
Our trial is over, life moves on, lessons learned.
So it will cost us an additional $50,000.00+ with the brand new home we purchased
once we complete the repairs required to our Heartland Homes home.
No structural engineer has ever been to our home on behalf of or representing Heartland Homes, at any time.
We were told during our 1 year warranty period, they were working on our issues.
However none of our issues were ever resolved and there was never any follow up with us regarding our
water issues from Heartland Homes, period.

Our new home construction. This is a image of our brand new home. In our opinion, our Heartland Homes built home should be up to code and have weep holes installed. Building code 2000 & 2003 both state "weep holes should be located in the first course of masonry, etc..."

NOTE
As it was discussed at our Court Trial against Heartland Homes Pittsburgh, in December 2008;
No where in the Heartland Homes warranty does it state when Heartland Homes has to have work/repairs completed.
There is no specific turnaround time where the work must be completed. *in my own words.
